Six Principles of IDEA

IDEA is part of the four significant statutes in the United States for special education. Most of the change occurred in 1997, and individuals must meet four requirements. In the text, “First, children must be between the ages of 3 and 21. Second, children must have specifically identified disabilities. Third, children must need special education, and fourth, in need of related when necessary to benefit from their special education. “ (Osborne, A. G., & Russo, C. J. 2003). The amendments of IDEA, which is Public Law 94–142 passed in 1975, addressed free appropriate public education to each student with a disability. According to the text, “(b) evaluate the success of these efforts, and © provide due process protections for children and families.” (U.S. Department of Education. 2015). This law is positive and healthy, which is what students with exceptionalities need in their corner. It improves the way children with disabilities were portrayed and educated; the law made it better for children with disabilities to excel at schools. The rule set up the United States as the world leader in early intervention preschools, infants, toddlers, and preschool children with exceptionalities.

The primary purpose of section 504 is to cover any condition that lessens what people with disabilities majorly. Schools put the 504 plans as support to kids with disabilities. People cannot discriminate against them; it helps them succeed in special programs such as speech-language therapy, occupational, physical, and behavioral treatment. Although 504 plans are not part of special education, schools have to write their 504 plans. Some students need movement breaks, or because they might have an issue with noise, they need to be in a quiet environment when taking tests. The behavior therapist can put the intervention plan in the 504 plans. IEP’s are more complicated than 504 plans, and each school district is different. Based on the text, “504 plans aren’t part of special education. So, they’re different from IEPs. 504 plans and IEPs are covered by different laws and work in different ways. But the end goal is the same: to help students thrive in school.” Stansberry, K. (2015).

Before the public law 94–142, more than half of all students with disabilities were not allowed in schools and received a substandard education. All special educators have to follow ethics and serve as advocates for children with exceptionalities. The current law, the Americans with Disabilities Act (ADA), became law in 1990. Civil rights laws rule against discrimination against people with disabilities everywhere; they have the same right and opportunities just like everyone else.

In the early years, children with disabilities were mistreated because people did not understand them. Although the people without education still think of them as stupid or so on. Before I worked with exceptionalities, I did not understand how each one has a gift, and they are brilliant. These laws are set up to help children with disabilities to move forward and receive the proper education. Schools have to hire educators with the right credentials, and they have to abide by the laws. Educators need to continue to learn so they can help children with disabilities to succeed.

Under ADA, Title I is for people with disabilities to get a job with benefits just like a regular person. Part of the law is managed and enforced by the U.S Equal Employment opportunity commission. According to the text, Title II “This title outlines the administrative processes to be followed, including requirements for self-evaluation and planning; requirements for making reasonable modifications to policies, practices, and procedures where necessary to avoid discrimination; architectural barriers to be identified; and the need for effective communication with people with hearing, vision and speech disabilities.”(U.S. Department of Education. 2015). Based on the text, Title III”, This title sets the minimum standards for accessibility for alterations and new construction of facilities. It also requires public accommodations to remove barriers in existing buildings where it is easy to do so without much difficulty or expense.” (U.S. Department of Education. 2015). Under Title IV, the author states, “This title requires telephone and Internet companies to provide a nationwide system of interstate and intrastate telecommunications relay services that allows individuals with hearing and speech disabilities to communicate over the telephone.” (U.S. Department of Education. 2015).

ADA Americans with Disabilities Act, within the text “As indicated in its preamble, the purpose of the ADA is “to provide a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities.” (Osborne et al., 2003). Section 504 The Rehabilitation Act of 1973 deals with Federal financial assistance to all schools. IDEA Individuals with Disabilities Education Act is a federal law that gave essential protections to students with exceptionalities; they allow free appropriate public education. They get an IEP; their parents need to be part of their plan, all professionals who deal with them must follow procedures. They need to be educated in the least restrictive areas. People are not allowed to treat them differently. Schools must follow regulations and educate children with exceptionalities together with children who are not disabled.

ADA is the Americans with Disabilities Act enacted to give equal opportunities, and without disabilities, it does not matter your sex, religion, race, age, or where you come from. Everyone is free to live where they want; they can work or purchase the car they want; they can receive services from the government and the same type of communication. In 2008, the ADAAA, which stands for the Americans with Disabilities Act Amendments Act, was signed into law and became effective on January 1, 2009. “Stansberry, K. (2015). Once children with exceptionalities turn eighteen years old, 504 plans can help them with the road to adulthood. They can get the proper services, and if the area does not have a 504 plan, they can get into the program, for example (VR) Vocational rehabilitation. Programs help with colleges, living in communities, and so on; VR managers and counselors are assigned to individuals with exceptionalities.
